Felix.AI Terms of Service
1. Acceptance of Terms
By adding and using the Felix.AI bot on your Discord server, you agree to abide by these Terms of Service and any additional terms incorporated by reference. If you do not agree to these terms, please refrain from using the bot.
2. Description of Services
Felix.AI can generate images based on a prompt that the user gives during the execution of a command. Other features include describing an image the user uploads and generating images based on user uploaded content
3. Use of Generated Content
Users are not allowed to use the images created on Felix.AI for commercial purposes and are made to only be used for personal enjoyment. Users are also prohibited from the use of the ai to generate images for illegal, harmful, or malicious purposes.
4. User Responsibilities
User�s responsibilities include:
� Not using the bot to create illegal content.
� Not attempting to work around the NSFW filters in non-NSFW channels.
� Not generating NSFW images under the age of 18, or what�s required by their local government.
� Not infringing upon the intellectual property rights of others while using the bot
� Not abusing the bot and taking the bot offline

6. Availability and Support
We do not guarantee continuous availability of these services and these services may be discontinued at any time. To receive support for our services, please check out the support server listed on our listing on Top.GG.
7. Limitation of Liability
The Felix.AI bot and its AI-generated images are provided on an 'as-is' basis, without any warranties, whether express or implied. We do not guarantee the accuracy, completeness, or reliability of the bot's output or its suitability for any particular purpose. Users acknowledge and agree that their use of the Felix.AI bot and any resulting AI-generated images is at their own risk. Users are solely responsible for any consequences of their interactions with the bot and the images it produces. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to all users. In such cases, Felixbot�s liability will be limited to the greatest extent permitted by applicable law.
8. Ownership of AI-Generated Images
While users are granted a limited license to use the AI-generated images produced by the Felix.AI bot, ownership of these images, including any intellectual property rights therein, remains with the respective companies. Users do not acquire any ownership rights or licenses to the AI-generated images beyond the scope of this license.
Users are prohibited from using the AI-generated images for any illegal, harmful, offensive, explicit, or malicious purposes. Additionally, users may not distribute, modify, sell, or otherwise exploit the AI-generated images beyond the scope of the granted license.
Users acknowledge that the AI technology used in the Felix.AI bot may have been trained on specific data sources. However, users do not gain any rights or ownership over the underlying data used to train the AI.
9. Changes to Terms
We retain the right to modify, update, or revise the terms and conditions at any time. Any changes to the terms will be effective immediately upon their posting on felixbot.io.
Felixbot will make reasonable efforts to notify users about significant changes to the terms. This may include sending notifications through the Felix.AI bot, or by prominently displaying notices on our website or platform.
By continuing to use the Felix.AI bot after the posting of any updated terms, users are deemed to have accepted the changes. If users do not agree with the modified terms, they should discontinue using the bot.
Users are encouraged to review the Terms of Service periodically to stay informed about any updates. Continued use of the Felix.AI bot after changes have been made will signify acceptance of those changes.
Changes to the terms will apply prospectively, meaning they will govern interactions with the Felix.AI bot that occur after the effective date of the changes.
10. Termination
We retain the right to terminate a user's access to the bot and its services under the condition of illegal content being detected and reviewed by a human. We may also terminate user�s access for abuse of our services, including repeatedly generating images to halt bot functionality or degradation of other user�s Quality of Service.
11. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and constructed in accordance with the laws of the state of Kentucky, United States, without regard to its conflict of laws principles.
Any disputes or claims arising out of or relating to these Terms of Service or the use of the Felix.AI bot shall be first attempted to be resolved through good-faith negotiations between the parties. If a resolution cannot be reached, the parties agree to mediate the dispute before a neutral mediator.
If mediation is unsuccessful, any dispute or claim that remains unresolved shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration proceedings shall be held in Louisville, Kentucky, and the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. However, Felixbot reserves the right to seek injunctive relief in a court of competent jurisdiction to prevent or restrain any unauthorized or illegal use of the Felix.AI bot.
Both parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Indemnification
By using the Felix.AI bot, users agree to indemnify and hold harmless Felixbot, its affiliates, employees, agents, and partners from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with the user's use of the bot or any violation of these Terms of Service.
In the event of any claim or demand, Felixbot will provide prompt notice to the user about the claim or demand. The user shall then assume full responsibility for the defense of such claim or demand and any related settlement negotiations, subject to Felixbot's approval.
The user agrees to cooperate fully with Felixbot in the defense of any claim or demand. Felixbot reserves the right to assume the exclusive defense and control of any matter subject to indemnification by the user
